INTERIM CONSENT ORDER TO VOLUNTARILY CEASE AND DESIST filed February 24, 2010. This matter was opened to the Board on or about December 3, 2009, by the filing of a Verified Administrative Complaint seeking the temporary suspension of Dr. Howell’s license to practice medicine and surgery. Dr. Howell filed an Answer denying the allegations in the Complaint. Subsequently, the Hearing was adjourned twice predicated on Dr. Howell’s Voluntary Surrender of his license. The parties being desirous of an interim resolution without the need for a hearing agreed to the terms of this Interim Consent Order. The Board ordered and Dr. Howell agreed to voluntarily cease and desist from the practice of medicine pending successful fulfillment of the terms of this Order. Dr. Howell must acquire an evaluation and assessment of his skills and his ability to practice medicine from a Board approved program; and he is to successfully complete a Board approved ethics and record keeping course. When all has been successfully completed and any and all reports developed have been provided and reviewed by a Preliminary Evaluation Committee (“the PEC”) and the Committee is satisfied with the results, the Board will consider Dr. Howell’s return to the practice of medicine with the following limitations: no CDS prescribing privileges; he must hire a Board approved monitor with prescribing privileges; he is to provide the monitor on a weekly basis a complete log of all patients seen and from whom prescriptions were ordered; and he is to ensure the monitor provide monthly reports to the Board. EFFECTIVE DATE: February 24, 2010.

FINAL ORDER OF DISCIPLINE filed February 17, 2010. This matter was opened to the New Jersey Board upon receipt of information that on or about April 13, 2009, the New York Board entered a “Determination and Order” which provided for the revocation of Dr. Patin’s license to practice medicine and a $50,000.00 fine. The Order also provided that the following specifications set forth in the Amended Statement of Charges were sustained: negligence on more than one occasion; incompetence on more than one occasion; fraudulent practice; making or filing a false report; unwarranted tests or treatment; conduct evidencing moral unfitness; and failure to maintain records. The disciplinary action taken by the New York Board against Dr. Patin’s license provided the New Jersey Board with grounds to take disciplinary action against his license to practice medicine in New Jersey, in that his New York license was revoked. Based on the findings and conclusions, a Provisional Order of Discipline (“POD”) was entered on December 14, 2009 and served upon Dr. Patin. Dr. Patin did not submit a response and upon review of this matter, the New Jersey Board determined that further proceedings were unnecessary and that the POD should be finalized without change. The New Jersey Board ordered the license of Dr. Patin suspended until such time as he holds an active unrestricted license to practice medicine and surgery in New York. Prior to resuming active practice in New Jersey, Dr. Patin will be required to appear before the Board, or a Committee of the Board, to demonstrate he is fit to practice medicine in New Jersey and that he holds an active, unrestricted license to practice medicine and surgery in New York. EFFECTIVE DATE: February 17, 2010.

CONSENT ORDER OF REPRIMAND filed February 9, 2010. This matter was opened to the Board upon receipt of an application for reinstatement of Mr. Scott’s license to practice athletic training in New Jersey. Mr. Scott’s license expired on January 31, 2009, nonetheless he practiced athletic training from March 10, 2009 to June 12, 2009. Mr. Scott’s license was reinstated on June 12, 2009, upon the payment of the appropriate fees. The Board ordered and Mr. Scott agreed to be reprimanded for the unlicensed practice of athletic training. Mr. Scott must pay a penalty in the amount of $250.00 contemporaneously with the signing of this Order. EFFECTIVE DATE: February 9, 2010.
